First item...it is expected (IMVHO)....loctite it, or use teflon tape....I do that with all my folders (BM or otherwise). If the pivot starts to back out, I bust out the blue loctite.Second item.....

To answer your question originally. No it's not the expected behavior of the lock in that condition.If the loctite doesn't help you, I'd say you have to send it in.
